To the maximum extent permitted under Pennsylvania law, Fusion Spa & Resort, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

SECTION 14 – HEALTH & WELLNESS DISCLAIMER

14.1 Nature of Services

Fusion Spa & Resort provides wellness, relaxation, and recreational services, including saunas, steam rooms, hammams, pools, hot and cold water features, body treatments, spa rituals, and related amenities (“Wellness Services”).

14.2 No Medical Advice

Wellness Services are not medical, therapeutic, or healthcare services and do not constitute medical advice, diagnosis, or treatment. You should consult a licensed healthcare provider before participation.

14.3 Assumption of Risk

Participation involves inherent risks, including heat, cold exposure, water immersion, dizziness, dehydration, fainting, cardiovascular stress, and slips or falls.

You knowingly, voluntarily, and expressly assume all risks, whether known or unknown.

14.4 Health Conditions and Eligibility

You represent that you are physically able to participate and have obtained medical clearance if required. Fusion Spa & Resort may deny or discontinue services if participation appears unsafe.

14.5 No Guarantee of Results

No wellness outcomes or benefits are guaranteed.

14.6 Personal Responsibility

You are responsible for monitoring your condition, following all instructions, and discontinuing participation if discomfort occurs.

14.7 Release of Liability

To the fullest extent permitted by Pennsylvania law, you release and hold harmless Fusion Spa & Resort, LLC from all claims arising from participation, except where prohibited by law.

SECTION 15 – PREGNANCY AND MEDICAL CONDITION ACKNOWLEDGMENT

By participating, you acknowledge that you are not pregnant or have obtained medical clearance, and that you do not suffer from conditions aggravated by heat, cold, or physical exertion.

Fusion Spa & Resort does not conduct medical screening.

SECTION 16 – SAUNA, STEAM, AND COLD PLUNGE RISK NOTICE

Use of temperature‑based amenities involves heightened risks including dehydration, overheating, hypothermia, fainting, and cardiovascular stress.

You agree to follow posted time limits, exit immediately if discomfort occurs, and avoid participation while impaired.

SECTION 17 – MEMBERSHIP‑SPECIFIC DISCLAIMER

Memberships provide access to amenities, not medical treatment. Availability is not guaranteed. Temporary closures and safety restrictions may apply. No refunds are provided based on perceived results.

Memberships remain subject to all waivers and disclaimers.

SECTION 18 – PRIVATE EVENT AND GROUP WAIVER

Booking parties agree all participants are bound by these Terms. Fusion Spa & Resort is not liable for group participant injuries. The booking party agrees to indemnify Fusion Spa & Resort to the fullest extent permitted by law.

SECTION 19 – DIGITAL WAIVERS AND MEMBER ACKNOWLEDGMENTS

You may be required to electronically sign a digital waiver, assumption of risk, or acknowledgment form prior to participating in certain activities (including, but not limited to, use of saunas, steam rooms, cold plunge, or wellness treatments). If you are pregnant, have a medical condition, or are booking for a group or private event, you must review and acknowledge additional notices, including a pregnancy and medical condition acknowledgment, membership-specific wellness disclaimer, and a private event/group waiver. Use of our facilities constitutes your agreement to all such digital waivers and policies.

SECTION 20 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Four Seasons Spa DBA Fusion Spa & Resort, LLC and its affiliates, directors, employees, agents, contractors, licensors, service providers, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party arising out of your breach of these Terms or violation of any law or third-party rights.

SECTION 21 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed; this does not affect the validity of remaining provisions.

SECTION 22 – TERMINATION

Obligations and liabilities incurred prior to termination survive termination for all purposes.

These Terms are effective unless terminated by you or us. You may terminate these Terms at any time by notifying us you no longer wish to use our Services, or when you cease using our site.

We may terminate this agreement at any time if you fail, or we suspect you have failed, to comply with any provision.

SECTION 23 – ENTIRE AGREEMENT

These Terms, together with any policies or operating rules posted on this site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements, communications, and proposals. Any ambiguities in interpretation shall not be construed against the drafting party.

These Terms and any separate agreements shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania and the United States of America, without regard to conflicts of law principles. All disputes shall be subject to the exclusive jurisdiction and venue of the courts located in Pennsylvania.

If any provision herein is deemed unenforceable under Pennsylvania law, such provision shall be limited or eliminated to the minimum extent necessary, and all remaining terms shall remain in full force and effect.
